Disclaimer

What we do and do not promise, what the numbers on our site mean, and what is your responsibility.

1. What this site and these programs are for

The Exponential Engine™ for LinkedIn and everything on our Sites are educational. We teach a system for building visibility on LinkedIn — positioning, profile, content, engagement and measurement — and we coach you to run it. We are not an employment service, a recruiting agency, a marketing agency retained to act on your behalf, or an investment of any kind.

Nothing on the Sites is a promise of any outcome, and nothing you read here creates a professional relationship until you are enrolled under our Terms of Use.

2. No guarantee of results

We do not guarantee any result. Not a level of reach, impressions, engagement, followers, connections, inbound messages, leads, clients, opportunities, job offers, revenue or professional recognition. Not any of it, at any level, in any timeframe.

Success depends on factors specific to you and outside our control: your starting audience, your industry and how crowded it is, your seniority and credibility, how much you already write, the quality of what you produce, how consistently you show up, how much time you actually invest, your willingness to be visible, and the behavior of LinkedIn itself.

We do not know your circumstances. The system works when it is worked. If you do not do the work, it will not produce a result, and buying a place in a program is not the same as doing the work.

3. About the figures you see on our Sites

Growth percentages, impression counts, engagement figures and similar numbers shown on our Sites are individual results reported by specific clients and drawn from their own LinkedIn analytics. They are what happened for those people, in their industries, with their effort.

They are not averages. We make no claim about typical or average results, and you should not read any figure as what you can expect. Analytics shown are as reported at the time; LinkedIn changes how it counts and displays metrics, and figures are not independently audited.

Where a figure covers a defined period — year over year, or across a number of months — that period is stated alongside it. Comparisons are to that client’s own prior performance, not to any benchmark.

4. Testimonials and endorsements

Testimonials on our Sites are the genuine opinions of the people who gave them, used with their permission and in the form they approved. They reflect one person’s experience and are not a guarantee, a prediction, or a representation of what anyone else will achieve.

Before publishing: the FTC requires disclosure of any “material connection” between you and someone giving a testimonial — payment, free or discounted programs, affiliate commission, an ongoing business relationship, or a personal relationship. Tell me whether any of the people featured received anything of value or have a business relationship with Fixant, and I will add the specific disclosure. If none did, I will state that plainly instead.

5. Forward-looking statements

Where we describe what a system can do, what a market is doing, or what results are possible, those are opinions and projections — not statements of fact and not predictions about you. Any forward-looking statement expresses our view at the time it was made. Conditions change, platforms change, and we are under no obligation to update them.

6. Not professional advice

We are not lawyers, accountants, financial advisers, tax advisers, recruiters, employment counsel or licensed therapists, and nothing we provide is legal, financial, tax, investment, employment or medical advice.

Before you act on anything you learn from us — particularly anything touching your employment agreement, non-compete, confidentiality obligations, employer social media policy, professional licensing rules, industry regulations, taxes or business structure — get advice from a qualified professional who knows your situation.

If you are employed, check your employer’s policies before publishing. Posting about your work, your industry or your employer can have consequences we cannot foresee and are not responsible for.

7. Your responsibility

You are responsible for what you publish. Everything you post under your name is yours — its accuracy, its tone, its legality, whether it breaches a confidentiality obligation, whether it discloses something it should not, and how people respond to it. We may review drafts and suggest changes; the decision to publish is always yours, and reviewing a draft is not approval of its contents or legal clearance of it.

You agree that we do not share in your success and are not responsible for your results, your decisions, or the consequences of anything you choose to publish.

8. LinkedIn and other platforms

We do not control LinkedIn. Fixant is not affiliated with, endorsed by, sponsored by or connected to LinkedIn Corporation or Microsoft Corporation in relation to these programs.

LinkedIn can change its algorithm, its features, its analytics, its terms of service and its enforcement at any time, without notice, and any such change can affect your reach and your results. LinkedIn may also restrict, suspend or remove an account. We have no control over and no responsibility for any of that.

You are responsible for complying with LinkedIn’s User Agreement and Professional Community Policies. Nothing we teach is intended to breach them, and you should not use anything we teach in a way that does.

9. Third-party tools and AI-generated content

Our programs reference third-party tools, which may include AI tools. We do not control their availability, pricing, terms, features or output, and any of those can change or be withdrawn at any time. We are not responsible for the cost of any tool you choose to use.

AI tools produce errors. Anything generated with an AI tool — text, images, video or analysis — can be inaccurate, misleading, biased or unintentionally similar to existing work. You are responsible for reviewing, fact-checking and editing anything you publish, including anything produced with a tool we taught you to use.

10. Affiliate relationships and recommendations

Before publishing: confirm whether Fixant earns any commission, referral fee, kickback or other compensation from any tool, platform or service recommended in a program or on the Sites. The FTC requires this to be disclosed clearly. Tell me either way and I will write the correct statement here — either the disclosure, or a clean “we receive no compensation for any tool we recommend”.

11. Awards, credentials and partner status

Awards, credentials and partner designations shown on our Sites describe Fixant and its principals. Microsoft AI Cloud Partner status reflects Fixant’s relationship with Microsoft as a partner organization. It is not an endorsement, certification, review or guarantee by Microsoft of these programs, their content or their results, and it does not mean Microsoft is involved in delivering them.

12. Intellectual property

All intellectual property on our Sites and inside our programs — including frameworks, methods, curricula, session recordings, templates, prompt and hook libraries, scoring rubrics, and named programs and components such as the Exponential Engine™, the four stages (Ignition, Fuel, Flywheel and Dashboard), the Momentum Room, the Engagement Multiplier, the Topic Well, the Post Blueprint, the Workshop Library, the Profile Diagnostic Report and Benchmark Sessions — belongs to Fixant, LLC. These names are trademarks and service marks of Fixant, whether registered or not.

Materials you create inside our programs belong to you. Materials we teach are licensed to you for your own professional use — not for resale, redistribution, teaching to others, or building a competing program or service. You agree not to replicate, reverse engineer or redistribute any part of the content. Section 6 of our Terms of Use sets out what you may and may not do.

13. Errors, omissions and changes

We work to keep the Sites accurate, but content may contain errors, may become out of date, and may be changed or removed at any time without notice. Prices, dates, inclusions, seat counts and schedules are subject to change until you enroll. We make no warranty that anything on the Sites is complete, current or error-free.

14. Limitation of liability

This page is part of, and read together with, our Terms of Use. The disclaimers and limitation of liability in those Terms apply to everything described here. To the fullest extent permitted by law, we are not liable for any loss, damage, lost profit, lost opportunity or lost revenue arising from your use of the Sites or your participation in a program.

Figures referenced on our Sites — including engagement growth, impressions, reach and client results — are individual outcomes reported by specific clients and drawn from their own LinkedIn analytics. They are not averages and are not guarantees of reach, engagement, leads, clients, revenue or any professional outcome. Individual results vary based on effort, consistency, starting audience, industry, and other factors outside Fixant’s control, including changes made by LinkedIn.
